Because of default in the pay ment of the indebtedness, secured by a Security Deed executed by Henry J. Jones Sr. and Glenice Jones to Mortgage Electronic Registration Systems Inc., dated March 18, 2005 in the amount of $84,800.00, and recorded in Deed Book 2944, Page 105, Dougherty County, Georgia Records; as last tran sferred to U.S. Bank National Association, a national ban king association, not in its individual capacity, but solely in its capacity as trustee for the Terwin Mortgage Trust, Series TMTS 2005-6HE, wit hout recourse by assignment; the undersigned, U.S. Bank National Association, a national banking association, not in its individual capacity, but solely in its capacity as trustee for the Terwin Mortgage Trust, Series TMTS 2005-6HE, without recourse pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in May, 2008 , during the legal hours of sale, at the Courthouse door in Dougherty County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All that tract or parcel of land lying and being in Dougherty County, Georgia, and being a part of the reserved area in Block A of Roseland Sub division, according to a map or plat of said subdivision as same is recorded in Plat Book 3, Page 3, in the Office of the Clerk of Superior Court of Dougherty County, Georgia, and being more particularly described on Exhibit A attac hed hereto and made a part hereof. Beginning at the Nort hwest corner of Lot 4 in Block A of Roseland Subdivision as shown on said plat , run thence in a Westerly direction along the South margin line of School Bus Road for a dis tance of 150 feet to a point, which point is the Northeast corner of the tract conveyed by W.L. Bush to Charles S. Gunn and Faye B. Gunn by that certain Warrant Deed recorded in Deed Book 524, Page 302, Dougherty County Land Records; run thence South along the East line of said Gunn tract for a distance of 257 feet to a point on the North line of Lot 10 in Block A of said subdivision; run thence in an Easterly direc tion along the North line of Lots 10 and 9 to the Sout hwest corner of said Lot 4; run thence in a Northerly direction along the West line of Lot 4 for a distance of 257.3 feet to the Point of Beginning.
which has the property ad dress of 108 Honeysuckle Drive, Albany, Georgia., toget her with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior mat ters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final con firmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed.
Said property will be sold as the property of Henry J. Jones Sr. and Glenice Jones and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
